Stupid 101

Welcome to Stupid 101.This is designed in hopes that someone will learn from my mistakes, misplaced loyalty and optimistic outlook, and generosity. Plus I refuse to deplete my savings anymore on legal fees for stupid advice and have decided to use social media because I am tired of getting screwed. And, having my actions mistakenly represented by anyone.
That said, I do admire loyalty in others. I am sorry if my comments caused anyone to stumble in their walk with Christ.

I love to fish and had lotsa dinero invested in fishing gear that I left in my house in Deming. Last blog I stated that an email went out to the ex for my fishing gear.. The following is printed from my email account, uncensored, and shared with my comments in red italicized lettering.

You are undeniably and thoroughly mislead in your thought process. The house is mine. So, yes the "premises" are mine. I did not ask you about refinancing. And, while I am the primary on the mortgage and your name is on there as an afterthought our "business" is NOT complete. Why don't you just rent a place to live and we can sell the house as stated in the final divorce decree. Sounds simple enough to me. I merely asked you to gather MY fishing gear. Not my stove, or my fridge, or my dining set, or my recliner, or my dresser-that my mother bought-,or any other thing I may have left until our business is mutually and amicably concluded. You can leave my gear at an agreed upon place.
And, this is the USA. You do not dictate nor censor my actions. By the way, I have all the communique between Tyler Munoz about refinancing under my name and adding you as an afterthought.

Probably best that way. U can send the mortgage payments that u are responsible for according to the divorce decree ( you are one year in arrears now) thru your attorney as well. The house is in need of a roof as well. I will agree to do the work, ( of course by written contract) and u can supply the materials. What supplier is your choice.

The above part of the divorce decree became void on 6/1/2013 when Nabal moved out while I had a hip replacement and my daughter came to take care of me. Plus, he had started trying to get a refinance under VA so he could keep the house. Hs remark, "You know I can't pay my half of the mortgage if I am paying rent at another place." Me, "of course not."
I refinanced the house under my name and income and added him as a co-borrower so he could show a FICO score and be able to apply for his own home loan as soon as possible. Another act that nullified  that part of the divorce decree once that new loan was signed
From 6/1/2013 to 12/1/2013 the garage still held all his tools and various "things" that i did not charge him rent for, nor restrict his access to. The spare closet held the majority of his clothes, the back yard a ton of his "stuff"--no rent charge.
When I had a yard sale, with the help of my SISTER, I got a text stating "Don't sell any of my stuff!"  What?!?!? Hadn't even considered doing that.

Again you are sadly mistaken. Is this the same roof you told me had "4 layers of shingles" when I bought the ones for the AC overflow. Looks to me that you can not be trusted to keep your word much less "do the work". "C u in court."

Please document any leaks caused by the need for a new roof. I will send the insurance adjuster to document your findings. The work will be given to a bonded and licensed roofer If the shingles need to be replaced.

There is no leak damage. The damage is from the sun. According to Allied insurance that wear and tear due to age IS NOT COVERED under our policy. Filing a claim will increase the premium whether it is approved or denied. It can also trigger a refusal to cover the house when our coverage period expires. I cannot take on any more debt. If u want to start.the process and indemnify me for the increase in premium that is acceptable. If not, I can declare bankruptcy and let the mortgage lender deal with it all.

Now why would I need to "indemnify" him? Is he going to or already has destroyed, or possibly improved, something in my house that he has refused to inform me about?
When I spoke with the insurance rep I was told that if there was any wind damage to the roof they would cover the new roof. And, no I will not depend on an unlicensed person to perform the work.
My attorney's response: "Make a big purchase and then file bankrupt since that is what he keeps threatening." Why would I file bankrupt? "Almost all our Senior citizens file. Not me.
Attorney #2: Put the house on the market. But, be aware that may trigger the finance company wanting the entire amount due within a few days." No wiggle room so to speak.
Attorney #3 That's why we are now recommending to our clients to cut ALL ties before the final divorce decree.

I just received the new insurance update. If you need to file personal bankruptcy by all means go ahead. But rest assured my house will not be included as part of your debt ratio. So I will deal with the mortgage company when and if you do file because you will not be living there.
